• MIT thinks it is above the law.

• The most recent time was in 2012 to 2013. MIT illegally released an unapproved bacteria into the Cambridge and Somerville MBTA Subway. Previously, MIT fed radioactive food and directly inject radioactive material into mentally disabled kids.

MIT managers told Dr. Egan to remove all mention of Bacillus subtilis from his slides and he did so…

• Dr. Egan emailed team biologist Dr. Fran Nargi asking what bacteria was being used.

• Dr. Nargi called Dr. Egan and told him it was Bacillus amyloliquefaciens. That is why he was told to change his slides. MIT was lying about what bacteria they were releasing.

The EPA regulates Bacillus amyloliquefaciens as a separate species from Bacillus subtilis

• “The Fernald State School, originally called The Massachusetts School for the Feeble-Minded, housed mentally disabled children along with those who had been abandoned by their parents.”

• “The boys didn't find out the whole story about their contaminated cereal for another four decades. During a stretch between the late 1940s and early 1950s, Robert Harris, a professor of nutrition at the Massachusetts Institute of Technology, led three different experiments involving 74 Fernald boys, aged 10 to 17. As part of the study, the boys were fed oatmeal and milk laced with radioactive iron and calcium; in another experiment, scientists directly injected the boys with radioactive calcium.”

• “But the real issues weren’t simply a matter of future health risk: the boys, who were especially vulnerable without parents and guardians looking out for their best interests in the state school, were used for experiments without their consent.”

• “When the case went to court, 30 former Fernald students filed suit against MIT and Quaker Oats. In 1995, President Clinton apologized to the Fernald students, since the Atomic Energy Commission had indirectly sponsored the study with a contract to the radioactivity center at MIT. A settlement for $1.85 million was reached in January 1998.”

• “But for Boyce, the pain of abuse lingers. “It’s a funny type of animosity. It’s a disappointing type of feeling,” he said of the researchers who had the opportunity to help, but instead took advantage of students in need.”

Nuremberg Code

• MIT lied by ignoring that the Nuremberg Code was issued on August 20, 1947, as part of the verdict of the Nazi Doctors’ Trial by the US military.

• This was before the MIT experiments on the children.

• Existing standards stated that MIT’s conduct was illegal and unethical.

• Sixteen Nazi doctors were found guilty of illegal medical experiments; seven were sentenced to death. The trial verdict by the military judges contained a section entitled "Permissible Medical Experiments." It also revised the original six points into ten, and these ten points became known as the "Nuremberg Code."

“1. The voluntary consent of the human subject is absolutely essential.

This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision…”

“…This latter element requires that before the acceptance of an affirmative decision by the experimental subject there should be made known to him the nature, duration, and purpose of the experiment; the method and means by which it is to be conducted; all inconveniences and hazards reasonably to be expected; and the effects upon his health or person which may possibly come from his participation in the experiment.”
